These Terms & Conditions (“Terms”) govern your access to and use of the HERZGEH online store, including purchases made through our website and related services.
By accessing our website, placing an order, or purchasing a product from HERZGEH, you agree to these Terms, together with our Returns & Refunds Policy, Shipping & Delivery Policy, and Privacy Policy, as applicable.
Nothing in these Terms excludes or limits any rights that cannot lawfully be excluded or limited under applicable consumer protection laws.

HERZGEH is the seller responsible for products purchased through this online store.
The store is powered by Shopify, which provides the ecommerce platform used to operate the store.
2. Eligibility, Account and Use of the Store
You may use this store and place orders only where doing so is lawful.
By placing an order, you represent that you have the legal capacity to enter into a purchase agreement or that you are acting with the permission of a person who has such capacity.
You are responsible for providing accurate, current, and complete information when using the store or placing an order.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You must not transfer, sell, assign, or provide unauthorized access to your account.
You must not use our website or services for unlawful, fraudulent, abusive, or unauthorized purposes.
You must not interfere with the normal operation or security of the website or attempt to access systems or information without authorization.
3. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, dimensions, colors, photographs, prices, and other information displayed on our website are accurate and up to date.
However, minor differences may occur between the product displayed on a screen and the physical product, including differences caused by:
- screen or device settings;
- lighting or photography;
- manufacturing tolerances;
- material characteristics; or
- minor product updates.
Such minor differences do not affect any rights you may have where a product is materially different from its description or otherwise fails to conform to applicable legal requirements.
Product availability is subject to stock.
HERZGEH may update, modify, or discontinue products where reasonably necessary. Such changes will not reduce any rights associated with an order that has already been validly completed.
4. Prices and Currency
Product prices are displayed in the currency applicable to the selected market or checkout.
Unless otherwise indicated, shipping charges, duties, import taxes, VAT/GST, and other applicable charges may be calculated separately and displayed during checkout or charged in accordance with our Shipping & Delivery Policy.
Prices, discounts, and promotions may change without notice.
The price applicable to an order will generally be the price displayed when the order is completed.
Price changes do not affect orders that have already been validly completed, except where correction is required because of an obvious pricing, technical, or system error and permitted by applicable law.
5. Orders
An order is considered confirmed when payment has been successfully authorized.
After completing an order, please review your order confirmation carefully.
HERZGEH reserves the right to refuse or cancel an order where reasonably necessary, including in cases of:
- product unavailability or stock errors;
- obvious pricing or product information errors;
- payment failure or payment irregularities;
- inability to ship to the requested destination;
- suspected fraud or unauthorized transactions; or
- legal, regulatory, sanctions, or carrier restrictions.
If HERZGEH cancels an order before fulfillment, any amount paid for the cancelled portion of the order will be refunded to the original payment method.
6. Product, Option and Quantity Changes
Once an order has been completed, products, options, or quantities generally cannot be modified directly.
If you need to change a product, option, or quantity, you may need to cancel the eligible order and place a new order.
Cancellation remains subject to the cancellation rules below.
7. Shipping Address Changes
Customers are responsible for providing complete and accurate shipping information.
A shipping address may be changed before a tracking number has been registered, provided that the order has not progressed to a stage where the change can no longer reasonably be made.
Once an order has been dispatched, HERZGEH cannot guarantee that a shipping address change will be possible.
Additional costs resulting from an incorrect or incomplete address may be charged to the customer as described in our Shipping & Delivery Policy.
8. Order Cancellation
Customers may request cancellation before the order has been fulfilled.
Once an order has been fulfilled or dispatched, it can no longer normally be cancelled as an unshipped order. Instead, the customer may request a return after receiving the product in accordance with our Returns & Refunds Policy and applicable law.
HERZGEH does not charge a separate order cancellation fee.
Cancellation requests are subject to the actual status of the order at the time the request is processed.
Nothing in this section restricts cancellation or withdrawal rights that must be provided under applicable consumer protection law.
9. Out-of-Stock Products and Inventory Errors
Occasionally, an item may become unavailable after an order has been placed because of inventory discrepancies or other operational issues.
If this occurs, HERZGEH may contact you to offer an available alternative or modification.
Where appropriate, you may choose between an available alternative and a refund for the affected item.
HERZGEH will not substitute a materially different product without your agreement.
10. Payment
Payment must be successfully authorized using a payment method available during checkout.
Payment processing may be provided by third-party payment service providers.
You are responsible for providing accurate and authorized payment information.
Your payment may also be subject to the terms, verification procedures, fraud screening, currency conversion practices, and processing rules of the relevant payment provider, card issuer, or financial institution.
HERZGEH may decline or cancel an order where payment cannot be successfully verified or where there are reasonable grounds to suspect unauthorized or fraudulent activity.
11. International Orders
HERZGEH ships internationally only to selected countries and regions.
International purchases may be subject to:
- customs duties;
- import taxes;
- VAT or GST;
- customs clearance charges;
- brokerage or handling charges; and
- destination-specific import requirements.
Unless otherwise stated, the economic responsibility for applicable destination-country import charges rests with the customer.
Depending on the destination, some duties and taxes may be collected during checkout, while others may be charged during importation or delivery.

12. Customs and Import Requirements
Customers are responsible for providing accurate information required for customs clearance, including any personal customs clearance number, Tax ID, identification details, or other information required by the destination country or shipping carrier.
Customers are also responsible for checking any import restrictions that apply in their destination.
HERZGEH may cancel an order before dispatch if we determine that shipment is prohibited, unavailable, or impracticable because of applicable law, import restrictions, sanctions, carrier restrictions, or other regulatory requirements.
If an affected order is cancelled, the amount paid for the cancelled order will be refunded to the original payment method.
Failure or refusal to complete customs procedures may result in additional costs as described in our Shipping & Delivery Policy and Returns & Refunds Policy.
13. Shipping and Delivery
Orders are generally processed within the timeframe described in our Shipping & Delivery Policy.
Delivery times shown on the website or during checkout are estimates unless expressly stated otherwise.
Customs clearance, local carrier operations, weather, public holidays, regulatory inspections, and other circumstances may affect actual delivery times.
Delivery delays, lost shipments, failed deliveries, refused shipments, incorrect addresses, and related matters are governed by our Shipping & Delivery Policy.
Nothing in these Terms transfers responsibility for shipment to the customer earlier than permitted by applicable consumer protection law.
14. Returns and Refunds
Returns and refunds are governed by our Returns & Refunds Policy.
Subject to the conditions described in that policy, customers may generally request a change-of-mind return within 14 days of receiving their order.
If items in the same order are delivered separately, the 14-day period begins when the last item in the order is delivered.
Products must be handled only to the extent reasonably necessary to inspect them.
Actual use, washing, contamination, damage, significant pet hair or odor, missing components, or other circumstances that materially reduce the value of a product may affect return eligibility or the refundable amount, to the extent permitted by applicable law.
HERZGEH does not charge a restocking fee.
15. Exchanges
HERZGEH does not generally offer direct exchanges for change-of-mind requests, including changes of color or product option.
Customers should return an eligible item in accordance with our Returns & Refunds Policy and place a new order for the preferred product.
This does not prevent HERZGEH from providing a replacement where a product is defective, damaged during shipment, incorrect, or incomplete.
16. Defective, Incorrect, Incomplete or Damaged Products
If a product is defective, incorrectly shipped, incomplete, or damaged during transportation, please contact HERZGEH promptly.
For efficient handling, we ask customers to report product defects, incorrect shipments, or missing components within 30 days of delivery, and shipping damage preferably within 7 days of delivery.
These reporting periods are intended to facilitate investigation and customer support. They do not limit any mandatory rights or legal guarantees available under applicable law.

17. Failed, Refused or Unclaimed Deliveries
If delivery fails because of an incorrect or incomplete address, customer absence, failure to collect a shipment, refusal of delivery, failure to provide customs information, or refusal to pay applicable import charges, the customer may be responsible for actual costs resulting from the failed delivery.
Such costs may include shipping, return shipping, customs charges, storage, clearance, brokerage, or other directly incurred expenses.
Where permitted by applicable law, those actual costs may be deducted from an otherwise refundable amount.
Refusal to pay applicable duties or taxes is not automatically treated as a standard change-of-mind cancellation.
18. Promotions, Discounts and Gifts
Promotions, discount codes, gifts, and special offers may be subject to additional terms displayed at the time of the promotion.
Where a promotion has specific terms, those terms will apply to the promotion to the extent they do not conflict with mandatory consumer rights.
Where an order containing a promotional gift is returned, HERZGEH may require the gift to be returned with the relevant products.
Coupons are not automatically reinstated following cancellation or return and may be subject to the terms of the specific promotion.
Products identified as Final Sale may be excluded from HERZGEH's voluntary return program where permitted by law.
A Final Sale or promotional designation does not override statutory rights that cannot legally be excluded.
19. Proper Use of Products
HERZGEH products should be used only for their intended purpose and in accordance with product instructions, warnings, setup guidance, weight or size recommendations, and other information provided with the product or on our website.
Customers are responsible for selecting a product that is appropriate for their pet and intended use.
Products used with pets should be checked regularly for damage, abnormal wear, loose components, or other conditions that could affect safe use.
Nothing in this section excludes or limits HERZGEH's liability where such liability cannot legally be excluded.
20. Website Content and Intellectual Property
Unless otherwise stated, the content available through the HERZGEH website—including text, photographs, product designs, graphics, logos, videos, illustrations, layout, and other materials—is owned by or licensed to HERZGEH and is protected by applicable intellectual property laws.
You may access and use the website for personal, non-commercial shopping and informational purposes.
Without prior authorization, you may not reproduce, distribute, modify, commercially exploit, republish, publicly display, or create derivative works from HERZGEH website content except where permitted by applicable law.
HERZGEH names, logos, product names, designs, and related branding may not be used without authorization except where permitted by law.
21. Third-Party Services and Links
Our website may use or link to third-party services, including payment processors, shipping carriers, social media platforms, and other service providers.
These third parties may operate under their own terms and privacy policies.
If you access a third-party website or service through our store, you should review that third party's applicable terms and policies.
HERZGEH is not responsible for the independent content, availability, policies, or practices of third-party websites or services, except to the extent responsibility cannot lawfully be excluded.
22. Relationship with Shopify
HERZGEH is powered by Shopify, which enables us to provide the online store and related Services.
However, sales and purchases made through this store are made directly between you and HERZGEH.
HERZGEH is the seller responsible for products purchased through the store.
Shopify is not the seller of HERZGEH products and is not responsible for the fulfillment, delivery, quality, safety, or performance of products purchased from HERZGEH, except to the extent otherwise required by applicable law.
Certain personal information may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy notices.
23. Prohibited Uses
You may use the Services only for lawful purposes.
You must not use the Services to:
- violate applicable laws or the rights of others;
- engage in fraud, impersonation, harassment, or other unlawful conduct;

24. Availability of the Website
We aim to keep the HERZGEH online store available and functioning properly.
However, access may occasionally be interrupted because of maintenance, updates, technical failures, third-party platform issues, security events, or circumstances outside our reasonable control.
We may modify, suspend, or discontinue website features where reasonably necessary.
This does not affect any obligations we already owe in relation to orders that have been accepted.
25. Errors and Corrections
Despite reasonable efforts, our website may occasionally contain typographical errors, incorrect prices, inaccurate availability information, technical errors, or other mistakes.
HERZGEH may correct such errors when discovered.
Where an error materially affects an order that has already been placed, HERZGEH will contact the customer where appropriate and provide a lawful remedy, which may include cancellation and refund.
26. Limitation of Liability
To the maximum extent permitted by applicable law, HERZGEH will not be responsible for indirect or consequential losses that were not reasonably foreseeable at the time the purchase agreement was formed.
HERZGEH is not responsible for losses caused solely by circumstances outside our reasonable control, except where applicable law provides otherwise.
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- death or personal injury where liability cannot lawfully be excluded;
- intentional misconduct or gross negligence where applicable;
- defective products where statutory liability applies; or
- any other liability or consumer right that cannot legally be excluded or limited.
27. Privacy
Our collection and handling of personal information are governed by our Privacy Policy.
Personal information may also be processed by service providers necessary to operate the store and complete orders, including Shopify, payment providers, shipping carriers, and other service providers.

28. Changes to These Terms
HERZGEH may update these Terms when reasonably necessary, including to reflect changes to our business operations, services, policies, or applicable laws.
Any updated Terms will display a revised “Last Updated” date.
Material changes will be communicated where required by applicable law.
As a general rule, changes will apply to orders placed after the updated Terms become effective and will not retroactively reduce rights associated with an order already placed.
Where applicable law requires otherwise, the applicable law will prevail.
29. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable in a particular jurisdiction, that provision will apply only to the maximum extent permitted by law.
The remaining provisions will continue to apply to the extent legally permitted.
30. Waiver and Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with the Returns & Refunds Policy, Shipping & Delivery Policy, Privacy Policy, and any other policies expressly incorporated by reference, constitute the agreement between you and HERZGEH regarding your use of the store and purchases made through it.
Nothing in this section limits rights or remedies that cannot legally be waived under applicable law.
31. Headings
Section headings are provided for convenience only and do not affect the interpretation of these Terms.
32. Governing Law and Consumer Rights
These Terms and purchases made from HERZGEH are generally governed by the laws of the Republic of Korea, subject to any mandatory consumer protection laws that apply to the customer's place of residence or the market in which HERZGEH offers its products.
Nothing in these Terms deprives a consumer of protections that cannot legally be waived under applicable law.
Any dispute will be submitted to a court or other competent authority having jurisdiction under applicable law.
33. Relationship Between Store Policies
These Terms should be read together with the policies displayed on the HERZGEH online store.
For specific matters:
- Returns & Refunds Policy governs returns, defective items, shipping damage, exchanges, and refunds.
- Shipping & Delivery Policy governs processing, delivery, international shipping, customs, duties, delivery delays, lost shipments, and failed deliveries.
- Privacy Policy governs the collection, use, storage, disclosure, and other processing of personal information.
If provisions of these documents appear inconsistent, they should be interpreted together where reasonably possible.
Any mandatory provision of applicable law takes precedence over conflicting store policy language.
